Terms of Use
These Terms of Use ("Terms") are an End User License Agreement between you and Yoan-Marko Iliev ("we", "us"), the developer of the Tallied app ("the app"). By downloading or using the app you agree to these Terms. If you don't agree, don't use the app.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, rent, sell or redistribute the app, except where the law allows it.
2. Your content
Everything you enter in the app (collections, items, prices, photos) belongs to you. We don't receive it or claim any rights to it. You are responsible for the content you add, and for making sure you have the right to photograph and record it.
3. Collaborating
When you share a collection, the people you invite can see it and change it. Only invite people you trust. You are responsible for what you share and with whom. Don't use sharing to send unlawful, harmful or infringing content.
4. Acceptable use
Use the app only for lawful purposes and in line with these Terms and Apple's terms. Don't try to interfere with the app, with iCloud, or with other people's use of them.
5. Accuracy: please check your numbers
Tallied adds up units and values from what you enter. Product recognition, barcode reading and price reading from labels are automatic and can be wrong. Review your totals and reports before you rely on them, for example for accounting, tax, insurance or reporting to donors or authorities. We are not responsible for decisions made on the basis of figures in the app.
6. iCloud and availability
Sync and sharing depend on Apple's iCloud service and your iCloud account and storage, which we don't control. We don't guarantee that the app will always be available, error-free or compatible with every device or iOS version. Keep your own copies (for example exported reports) of anything important.
7. No warranty
To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, arising from your use of or inability to use the app. Our total liability for any claim relating to the app is limited to the amount you paid for it, if any. Nothing in these Terms limits liability that cannot be limited by law.
9. Apple
These Terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. We, not Apple, are responsible for handling any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, and claims that the app infringes a third party's intellectual property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Termination
This license lasts until ended by you or us. It ends automatically if you break these Terms. You can end it at any time by deleting the app. Sections 2 and 5–11 survive termination.
11. Governing law
These Terms are governed by the laws of JURISDICTION_PLACEHOLDER, except where the consumer protection laws of your country of residence give you rights that cannot be waived.
12. Changes
We may update these Terms. We'll post the new version here with a new effective date. If you keep using the app after a change, you accept the updated Terms.
